Justice Watch: Prosecutor to Seek Death Penalty in Toddler Torture Murder

Scott McMillan, the toddler murdered by his mother and her lover of one month, was buried one week ago in a tiny casket supplied by a local mortuary in a graveside service attended by his remaining family members, aunts, uncles, grandmother.  

 

As the headlines continue, the graphic horror of Scotty McMillan's death is yesterday's news for most, except those haunted by the details and the prosecutor who vows and rightly so, to seek the death penalty for the two monsters accused of systematically torturing the three year old until he eventually died.

When the news of this "American horror story" hit the airwaves, the raw details were stunning as the two lovebirds seemed intent on over-kill of the toddler. As the revelations of layer upon layer of brutal, vicious abuse used to cause repeated black outs in which the two would revive the child for the singular purpose of torturing him again surfaced it seemed surreal given the details of their relationship.

Jillian Tait, 31, the by all accounts, save this one incident, a fun loving party girl who three years ago saw a much different ending to the news of her pregnancy. The ultrasound posted on her Facebook page had the tones of impending motherhood she was looking forward to the experience and addition to her little growing family.

Scotty's father, Loren McMillan, a handsome strawberry blonde, and Jillian appeared to be the perfect, at least color matched, couple. They produced a beautiful red headed little man, with handsome looks, smoky brown far away eyes.

A young unskilled family, with two handsome boys and hopes of forever quickly saw it dissipate as the money woes whittled down their devotion and professed loves and put an end to the predilections for the party life.

The recession and economic collapse that sent unemployment numbers skyrocketing and knocked Pennsylvania residents, more than in any other time in history, into a spiral of financial worries, bankruptcy, poverty and an abyss of despair didn't bypass the young McMillan-Tait family.

Pictures of Jillian have appeared with her in better days dancing. The two, in the truest sense of the cliché, may not have had money but they had love until of course the lack of money dried up the love and replaced it with bitter, heated arguments.

The relationship couldn't hold the stress and didn't last and from all account Loren McMillan abandoned the boys, Scotty, 3, and his brother Ryan, 6,   to return to Kansas to live with his mother. He has stated he had no contact with Jillian or his children. His deadbeat dad status solidified his additional statements of sorrow and concern is filtered through the realities that have brought attention to him. His absence at Scotty's funeral was noted.

Gary Fellenbaum, 23, the younger man in this love triangle that played out in the home of his ex-not yet divorced, wife, Amanda who sketchy background has not produced the typical violence and deeply dysfunctional state one would associated with the type of violence he inflicted upon Scotty.

Possibly the constant reminder of the boy's father, the strawberry blonde good-looking, tall, lean man and an off handed remark of "My Daddy" at breakfast drove the 275 lb Fellenbaum into a fit of rage that initiated the days of "discipline."

For the next three days, Amanda Fellenbaum, the not yet ex-wife of Gary Fellenbaum, sat in the single wide typical trailer, with a railroad style set up, within ear and eye shot of the violence and did nothing.

Her remarks of not wanting to get involved don't fly as the violence occurred in her home and thus by association make her a suspect in the abuse and as guilty and could even be grounds to create reasonable doubt in the mother's defense sending her to death row also.

The murder of our handsome little man, executed with the fierceness of rabid animals ripping away at his flesh, has increased the need for further review by the prosecutors to ensure that all in an ever widening circle of culpability are held accountable.

School officials have been cleared. Failure to pay child support is a crime, the deadbeat dad has some level of responsibility, the not yet ex-wife, Amanda Fellenbaum, is as guilty as the perpetrators as she allowed in full view, and did not intervene for more than three days. The weeping relatives, who fortunately didn't get the 15minutes hoped for at Scotty's funeral, have some responsibilities under the law.

The lover's will have to wait another month before they see the inside of a courtroom as the preliminary hearing originally scheduled for November has been postponed until the middle of December. The presiding magistrate, Michael Cabry of Honey Brook, requested the continuance. Those familiar with the case have also indicated the national attention to the case will move the proceedings to the Chester County Justice Center for security and space.

The purpose of the hearing is to establish the criminal case against the trio, Gary Lee Fellenbaum III, Jillian Tait and Amanda Fellenbaum which shouldn't be difficult as apparently all three, separately, described without remorse, the same scenario that of Gary Fellenbaum brutally beating the 3 year-old, with a variety of torture instruments until he blacked out to which he was revived and beaten again over the course of three days.

The toddler was strung up like an animal by his feet and repeatedly beaten with a frying pan. It is unclear if he was dropped on his head from the hanging position although court documents have indicated Fellenbaum has admitted to ramming the child head-first into the wall.

Found on an defalted air mattress bleeding from mouth and nose, Scotty McMillan died on the way to the emergency room after EMT responded to a call of an "unresponsive child." What they found challenged even the most jaded and caused those accustomed to trauma to weep.

Chester County District Attorney Thomas Hogan has vowed to seek the death penalty against the pair. With additional charges against Amanda Fellenbaum still under investigation she has been charged with endangering the welfare of a minor to which the D.A. is seeking the fullest penalty under the law.
